Selection of sex is effectively banned in India under sections 3, 4, and 5 of Pre-natal Diagnostic Techniques (Regulation and Prevention of Misuse) Act, 1994 (PNDT), as amended in 2002. Further, the advertisement of any techniques used for sex selection as well as those used for sex determination is prohibited under Section 22 of PNDT read with Section 69A of Information Technology Act, 2000. Any act violative under PNDT is classified to be a cognizable, non-bailable, and non-compoundable offense.
Babyready does not, under any circumstance, allow sex determination tests to be undertaken unless there are other absolute indications for termination of the pregnancy as specified in the Medical Termination of Pregnancy Act, 1971.
